NON-DISCRIMINATION and INTERCONNECTION POLICIES
EvenLink, a company established with the highest standards,
commits to the following Nondiscrimination and Interconnection Obligations:
i. EvenLink will adhere to the principles
contained in the FCC's Internet Policy Statement
(FCC 05-151, adopted August 5, 2005);
ii. EvenLink will not
favor any lawful Internet applications and content over others;
iii. EvenLink will display all network
management policies in a prominent location on the company web site and provides
notice to customers of changes to these policies.
EvenLink describes all business practices
or technical mechanisms employed, other than standard best efforts Internet delivery, to
allocate capacity; differentiate among applications, providers, or sources; limit usage; and
manage illegal or harmful content;
iv. EvenLink will connect to the public Internet directly, such
that the EvenLink's networks are not entirely private closed networks;
v. EvenLink will offer interconnection,
including wholesale access to network components and services such as fiber optic wavelength or
fibers, where
technically feasible without exceeding current or reasonably anticipated capacity limitations, on
reasonable rates and terms to be negotiated with requesting parties.
This includes both the ability
to connect to the public Internet and physical interconnection for the exchange of traffic.
NETWORK MANAGEMENT POLICIES
i. A software spam filtering system is applied to all email processed by EvenLink's mail servers.
End users are provided with a web-based control panel that may be used to adjust the operation of the spam filtering system as it applies to their account.
ii. EvenLink's VoIP CPE may prioritize voice traffic over other Internet traffic in order to maintain a high level of voice quality.
ARRA-RELATED POLICIES
i. EvenLink currently offers wholesale access to network components and services such as fiber optic wavelength or
fibers at reasonable rates and terms,
and will continue to do so for all ARRA-funded infrastructure.
ii. EvenLink commits to binding private arbitration of disputes concerning interconnection
obligations related to all ARRA-funded infrastructure.
iii. EvenLink currently allows a choice of providers to end users.
Other providers currently serve end users using existing EvenLink infrastructure,
and EvenLink will continue to allow other providers to serve end users using any ARRA-funded infrastructure.
iv. EvenLink offers a 25% discount on all ARRA-funded infrastructure services to "Critical Community Facilities"
- public facilities that provide community services
essential for supporting the safety, health, and well-being of residents, including, but not limited
to, emergency response and other public safety activities, hospitals and clinics, libraries and
schools.
ARRA-FUNDED INFRASTRUCTURE
i. On August 14, 2009 EvenLink submitted grant applications to RUS and NTIA for several ARRA-funded broadband infrastructure projects.
The grant applications are currently in the review process.
ii. Should EvenLink be awarded one or more infrastructure grants, details of the ARRA-funded infrastructure projects including Service Area maps and
network diagrams will be made available here.
All of the above policies are subject to the needs of law enforcement and reasonable
network management.
Thus, EvenLink may employ generally accepted technical measures to
provide acceptable service levels to all customers, such as caching and application-neutral
bandwidth allocation, as well as measures to address spam, denial of service attacks, illegal
content, and other harmful activities.
In addition to providing connections to the
Internet, EvenLink may offer managed services, such as telemedicine, public safety
communications, and distance learning, which use private network connections for enhanced
quality of service, rather than traversing the public Internet.
